1. General conditions of contract and sale.
The following general terms and conditions of contract and sale govern all contractual and sales relations and all commercial transactions that are concluded through the site www.biofficinatoscana.com, between Biofficina srl and customers / consumers. The customer / consumer is understood to be the natural person who concludes a contract for purposes unrelated to any entrepreneurial and / or professional activity carried out. In this regard, the purchase for purposes other than those of direct consumption of the product is to be considered illegitimate and not permitted by Biofficina srl. For this reason Biofficina srl may, at any time, deny purchases and / or commercial transactions from its website www.biofficinatoscana.com.
The customer / consumer accepts the general conditions of contract and sale by placing the order once the cart filling procedure has been completed and, consequently, having concluded the choice of items on the site.
The customer / consumer is obliged to carefully read the general conditions of contract and sale which in any case are understood to be read and understood with the placing of the order by the same. In any case, any changes made, for any reason and in any way, by the consumer customer to these conditions will be rejected by Biofficina srl unless it has specifically approved them in writing.
2. Order and purchase procedure
The customer / consumer chooses the products on the Biofficinatoscana.com site and when he has concluded the choice goes to the checkout phase in two ways: the first is, if he had already purchased on the website, that of the login while the another is the registration of an account. Each customer who buys on the Biofficinatoscana.com site must be registered with a personal account. To register the account, the customer / consumer must enter personal data (name, surname, password [which will also be used for future access], date of birth) and the data of the residential address, as well as the name and ” shipping address (Name, Surname, Address, Zip Code City, Country, Tax Code, a telephone). The customer / consumer can also authenticate on the site through their Facebook account. Subsequently, he will choose the shipping method (eg Express courier, collection in store, etc. etc.) with the possibility of leaving a message and, consequently, he will choose one of the proposed payment methods (Bank transfer, Paypal etc. etc.). Before confirming the purchase order, the unit cost of each selected product will be summarized, the total cost in the event of the purchase of multiple products, the cost of additional expenses based on the type of payment selected and the amount of shipping costs. By sending the order, the procedure is technically concluded and the consumer customer expressly accepts the terms and conditions of the contract and sale. Subsequently, the customer / consumer will receive a summary of his order in his mailbox, entered during registration. At this stage, Biofficina srl reserves the right to accept or not the order which may be rejected even only and exclusively due to the lack of data deemed essential to it (eg tax code).
Once the purchase order has been confirmed, the customer will receive an e-mail confirming receipt and acceptance of the order, containing all the information on the products purchased, a detailed indication of the price, shipping costs, applicable taxes and of the means of payment. In addition, information on the right of withdrawal will be entered. With the acceptance by Biofficina srl, the contract is considered concluded. It should be noted that the images and descriptions relating to the products are purely indicative and may differ from the actual product and are obviously for illustrative purposes only.
3. Payment method
Biofficina srl allows the payment of the ordered goods in the following ways and terms:
Advance bank transfer: it is possible to pay for the order by bank transfer to the current account in the name of Biofficina srl. The bank details of Biofficina srl will be communicated in the last step of order confirmation where the reason to be included in the transfer will also be indicated. The ordered products will be sent after the receipt of the transfer by Biofficina srl. If the transfer is not received within 5 days of the order, it will be canceled. There are no surcharges for this payment method.
Credit Card: you can pay with any card of any circuit including Visa, Mastercard and American Express. Holders of Postepay and Banco Posta click cards, which run on the MasterCard and Visa Electron circuit, can also pay by credit card. There are no surcharges for this payment method.
Paypal: it is possible to pay for the order through the Paypal circuit, using your personal Paypal account or by choosing not to register for the Paypal service. If the payment of the products is not made within 3 days from the date of the order, unless otherwise agreed between the customer and Biofficina srl, the order will be canceled and, if necessary, the purchase procedure must be reproduced. Through the Paypal circuit there is the possibility of proving the payment also with Visa and MasterCard credit cards. There may be a surcharge for this payment method.
4. Prices, packaging, shipping and transport of the order
The prices applied are those indicated on the website at the time of the purchase order by the Customer. The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products. All prices are total; they include the cost of packaging and VAT.
Biofficina srl is also ecologically attentive in packaging: the boxes are filled and packed with recyclable paper and closed with the new gummed paper made with 100% biodegradable materials of vegetable origin, instead of the more usual adhesive tape.
In addition to the prices of the products, the shipping costs must be added, the information of which is visible on the site. These expenses, where present for orders with a lower value, will still be visible to the customer / consumer in the order summary.
Biofficina srl sends shipments using primary national and international couriers duly authorized.
Delivery times, in accordance with the provisions of art. 6 of Legislative Decree no. 206/2005, are on average 3 working days and do not exceed 30 days starting from the day following that of transmission of the order. The invoice will be issued to the customer / consumer in the package sent and via e-mail, using the data entered by the customer himself when registering his account on the website.
The goods travel on behalf and at the risk of the customer / consumer; Biofficina srl will therefore not be responsible for any delays or damage resulting from transport. In the event that the goods arrive visibly damaged, the customer / consumer is obliged to collect the package by signing the conditional receipt, otherwise it will not be possible to request any refund from the courier. In the event of a refusal of the shipment, Biofficina srl may request the customer the full amount of the shipping costs and the cost incurred for the return of the same to the sender. The delivery terms indicated by Biofficina srl refer to the products in the warehouse and are to be understood as non-binding as they can be modified by Biofficina srl for its own needs. Biofficina srl reserves the right to deliver the products relating to the same order in multiple deliveries without further charges to the customer. Special terms and conditions of delivery must be agreed in advance by e-mail or by telephone between the customer / consumer and Biofficina srl and accepted by both parties. Any special offers or promotions proposed by Biofficina srl are valid until they expire or until the products subject to the promotion are exhausted.
5. Right of withdrawal
Pursuant to Legislative Decree 206/2005 and Directive 2011/83 / EU, the customer / consumer has the possibility to withdraw from the purchase contract and return the goods received, without any reason, within 14 working days, returning them to our warehouse.
If the goods have not yet been sent, you have the option to withdraw from the contract by simply writing an email to customer service. In this case, the expiration of the right of withdrawal is calculated taking the receipt of this text in writing as the first day. The cost of the returned goods will occur within 30 days of returning the goods and verifying their compliance, without additional costs for the customer / consumer.
The right of withdrawal cannot be exercised and / or will not be effective in the following cases:
contracts for the supply of goods that have been specifically created for the needs of the customer / consumer and for which the production has been required an individual choice clearly adapted to the personal needs of the users;
contracts for the supply of goods that can be damaged quickly and whose return has been made after the maximum return date;
goods returned after the maximum return period;
sealed goods that are returned without a seal;
edible goods or goods for personal hygiene that have been opened, used or tried;
goods returned obviously opened, used, tampered with, damaged;
goods purchased in multipacks and returned only in part.
Unless otherwise specified, the general provisions of the law apply. Biofficina srl guarantees only the material integrity of the products at the time of delivery. Any defects must be communicated by the customer / consumer, under penalty of forfeiture, no later than 10 (ten) days from the date of delivery. The customer / consumer has the right to have the damaged products replaced after returning them. The customer / consumer has no right to compensation for any damage, even further. The shipping costs necessary for the replacement of products are to be considered charged to the customer / consumer. Without prejudice to the hypothesis of willful misconduct or gross negligence on the part of Biofficina srl, it is agreed that any liability of Biofficina srl cannot exceed the price of the products purchased by the customer / consumer and which have become the subject of dispute. The warranty is excluded for defects caused by the customer. This is especially true in the case of misuse or unauthorized repair attempts. Any liability of Biofficina srl is excluded from the guarantee.

8. Changes and / or additions to the general conditions of contract and sale
Biofficina srl reserves the right to modify and / or supplement the general terms and conditions of the contract and also to adapt to new laws. The customer / consumer is obliged to read the conditions before each purchase, taking into account that the new general conditions of contract and sale will be valid and effective at the time of publication on the website www.biofficinatoscana.com. If any provision of these General Conditions of Contract and Sale should be invalid, the same does not affect the other clauses which in any case remain valid and effective.
9. Applicable law and competent court to settle disputes
These General Conditions of Contract and Sale are governed by Italian law and in particular by Legislative Decree. 6 September 2005 n. 206 on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
If disputes of any nature arise between Biofficina srl and each customer / final consumer, arising from the General Conditions of Contract and Sale, the only competent court is exclusively that of Lucca.
